Straight answers to the questions injured Californians ask most. For specific advice on your case, schedule a free consultation directly with an attorney.
In California, the statute of limitations for most personal injury claims is two years from the date of the injury under Code of Civil Procedure Β§ 335.1. For claims against a government entity, you typically have only six months to file an administrative claim. Wrongful death claims also generally have a two-year window. These deadlines are strict, so contact an attorney as soon as possible.
Even seemingly minor accidents can lead to injuries that worsen over time, and insurance companies are skilled at minimizing payouts. A consultation with an attorney is free, and we can quickly evaluate whether your case warrants legal representation. If it doesn't, we'll tell you honestly.
It means you pay nothing upfront and nothing at all unless we recover compensation on your behalf. This is called a contingency fee arrangement. Our fee is a percentage of the final settlement or verdict, agreed upon in writing before we begin work. If we don't win, you owe us nothing.
California law allows recovery for medical expenses (past and future), lost wages, loss of earning capacity, pain and suffering, emotional distress, property damage, and in cases of egregious misconduct, punitive damages. The specific compensation depends on the severity of your injuries and the circumstances of your case.
The vast majority of personal injury cases settle before trial, often without even filing a lawsuit. However, we prepare every case as if it will go to trial, because that preparation is what gets insurance companies to offer fair settlements. If a fair settlement isn't possible, we are fully prepared to take your case to court.
Seek medical attention immediately, even if you feel fine. Document the scene with photos, get contact information from witnesses, and file a police report when applicable. Do not give recorded statements to insurance companies before speaking with an attorney. Then call us, the consultation is free and we can guide you through what comes next.
